Reading Email Jan 15, 2005 (AXcess News) Houston - The Attorney General of Texas and Microsoft (Nasdaq: MSFT) have each filed separate law suits against a University of Texas student and his partner who allegedly operated the world's fourth largest email spam business.Texas attorney general Greg Abbott was successful in nailing two of the world's biggest spammers this week in what could be considered one of the biggest hauls in online fraud by authorities since the government passed the Can-Spam Act.

For the past year I have been using a program called "Boxtrapper". Until this time I had been relying on various spam filters that used keywords or other factors to determine if an email was spam. The success rate for this type of filtering varied as spammers eventually found ways around the "formula" being used by the filter. For example, the word "Valium" may be flagged as a spam indicator while the misspelled version, "Va Lium", would get by unnoticed. This is just one of many examples of how spammers manipulate words to beat filtering. The biggest problem is when spammers "spoof" the header information in an email so it's nearly impossible to trace who sent the message. I have even seen instances of people receiving spam emails that appear to have come from themselves!

Email Software In a separate law suit in Seattle, Microsoft has joined the Texas attorney general's office in suing the two spammers for sending unsolicited email to millions of MSN users.

  • Spam is not going to disappear from inboxes, nor is the volume of spam going to decrease in the near future. Spammers will continue to look for new ways of evading antispam protection, and antispam experts will continue to repel spam attacks successfully.

The AG's office in Texas said the duo were not licensed in that state to offer mortgage financing and that these spammers were selling those leads, in some cases, for as much as $28 a piece.AdvertisementAccording to the Texas AGs office, the two are being charged with violating both the federal Can-Spam Act as well as the Texas Electronic Mail and Solicitation Act, which allows for penalties of up to $10 per unlawful e-mail or $25,000 per day, and the Texas Deceptive Trade Practices Act, which authorizes penalties of up to $20,000 per violation. Under the federal Act the two spammers face penalties of $250 per violation, up to $2 million.

Fight Spam In Microsoft's suit, the software giant is seeking damages of $1,000 per email the spammers sent to MSN users. Microsoft filed its lawsuit in federal court in Seattle. The Texas spammers' suit marks the 89th such legal action the Redmond-based software company has filed.

"We don't think the (attorney general) has a case".

Spam Emails The Texas attorney general's office filed its lawsuit Thursday. Microsoft filed its suit Friday. The Texas lawsuit marks the first such case filed by the attorney general's office there.

Email Account Texas attorney general Abbott commented on the case Thursday, saying, "We want to make it clear that these defendants we are suing today and any other illegal spammers in the state of Texas can't hide behind a computer screen any longer."
