Who REALLY owns the domain
name
Don t be fooled. Proxy registrations do nothing more
than give you the right to use the domain name, called a
license. You do not legally own the domain! Look carefully at
their proxy agreements. These agreements are deceptively
crafted to state that, while you retain the full
benefits of domain registration, the proxy provider
remains the actual registrant of the domain. In fact, until
more recently, Domains-By-Proxy s website previously
stated: Your domain is registered in our name, which
means Domains By Proxy takes ownership of it.

They have since revised their website to remove the
ownership language, probably because it made too

recognize the licensee (aka you) as the owner of record.

services that offer to hide your name are simply complicated
ways of saying, You don t own it we do!
It s a lot like leasing a car; you can fix it, refuel it,
and drive it wherever and whenever you want, but you don t
own it. So, how well do you trust the proxy company to give the
domain back to you when you want to transfer the domain

Why does this ownership issue matter to you, the customer
Well, if the proxy companies are (legally speaking) the
recognized registered name holder, then they carry the burden
of any civil or criminal liability for all activities
associated with the domain name. If you do something bad with
your domain name, the person who will get sued or
criminally prosecuted is whoever is listed as the registered
name holder. That s why the proxy companies are so
eager to cancel privacy and publicize your precious contact
information to the world. They figure, if they re no longer
listed as the registered name holder, they can t be sued or
criminally prosecuted. Translation: Proxy companies have
every incentive to cancel your privacy service at the first
sign of trouble. Remember, they want your money, not

How does Dynadot s Privacy Service
work
Dynadot s Domain Privacy Service operates like a
forwarding service. We simply insert our own company s
address, email, and customer service telephone number in place
of your own information in the Whois lookup directory. But, we
do not replace your name. When we receive mail or email
addressed to you, we filter it for spam and bulk junk mail.
Then, we forward legitimate first-class mail and emails to you.
This ensures that you only get the important stuff, and not the

spammers, stalkers, harassers, data miners, and identity

4. What is spam Spam is email that is both
unsolicited and in bulk. Unsolicited means that the recipient
has not granted permission for the message to be sent. Bulk
means that the same message has been sent to many people
usually all at once. An email that is unsolicited but not sent
in bulk is fine, such as asking about a product before buying
it. An email that is sent in bulk but not unsolicited is fine,
such as sending a newsletter. But sending an email that is both

5. What is your Spam Policy Dynadot does not allow its
services to be used for the transmission of spam. If we receive
any complaints about your domain being used to send spam, we
will promptly start an investigation. First, you will receive
an email warning from us notifying you that we have received a
spam complaint for your domain(s), and asking you to stop
sending spam. If you choose to ignore our warning, and continue
to send spam, we will deactivate your domain or disable your
entire Dynadot account. (This depends on the severity of the
situation.) You will no longer be able to control the name
servers for your domain(s), and instead a Dynadot domain
cancelled for spam abuse page will appear in its place.

Spam Complaint. 6. Someone stole my Dynadot
account! How can I get it back If this is the first time that
this has happened to you, we will make a one time exception and
help you get your Dynadot account back once you have proven
that you are indeed the true account owner. In regards to any
subsequent account break-ins, we cannot help you get your
account back since you and you alone are responsible for the
security of the account. Dynadot has invested a good amount of
effort into maintaining the security of our system. It is the
sole responsibility of the creator of the account to keep his

you believe your copyright or other intellectual property right
is being violated by one of our customers, please submit a
Copyright Complaint here. Be sure to forward
us any evidence or proof of infringement so that we may better
serve you. We will initiate an investigation, and take action
where we find conclusive proof of infringement. Please be aware
that in some cases we may require you to provide us with a
court order or administrative order before we are able to

complaints without the backing of an order issued by a court of

I am violating their copyright. What can I do to defend myself
If a third party submits to Dynadot a Copyright Complaint
against your domain, we will send you an email notification of
such receipt. If you receive email notification of a Copyright
Complaint and investigation, you may dispute the claim of
infringement. One of the things we may ask from you is that you
submit to us a Counter-Verification, which is your
signature-certified declaration refuting the contents of the

9. What is a Counter-Verification A Counter-Verification is
a signed and certified document that you submit to us in order
to dispute a Copyright Complaint that a third party has lodged
against you. By submitting a Counter-Verification, you are
certifying under penalty of perjury any facts and/or evidence

domain name and/or website. A Counter-Verification

ignore that email and choose to wait for the 6 days to pass,

/i If you feel someone has hijacked your Dynadot account,
you should immediately notify our staff at
info@dynadot.com. We will open an
investigation into your complaint. First, we will ask you to
provide us with proof that you are in fact the true account
owner. Then, we will give the other party an opportunity to
respond and prove that they are the true account owner. We
require documentary evidence, such as emails and screenshots of
orders processed through the account. If you do not promptly
respond to our inquiries, there is a risk that you will lose
any claim to the account, and the investigation will be closed.
While Dynadot will make every effort to assist persons who have
fallen victim to account hijacking, we cannot guarantee any
specific result or outcome of any investigation. Note that
this complaint procedure may only be used once per account;

There is an alternative: just query the central
registry s whois server directly to see if a domain name is
in use. *nix users have a Whois client included with the OS,
which allows command-line enquiries like whois

which top-level domain you re looking for, the domain
registry (not just the registrar) may also offer a web-based
